Public Agreement for Domain Name Registration and Support Services

This agreement is an offer (public offer) for any legal entity or individual to enter into an agreement for domain name registration and support services. The agreement is public under Article 633 of the Civil Code of Ukraine, and its terms are the same for all consumers. Under Article 642 of the Civil Code of Ukraine, acceptance is confirmed by payment for services or registration on the Provider's website at ukrainiandomains.com.ua.

Key Terms

1. Subscriber means an individual or legal entity that has accepted this Agreement and paid for the Provider's services.
2. Account means a user account on ukrainiandomains.com.ua containing Subscriber information and used for accounting, personalization and authorization.
3. Provider means a person registered in Ukraine that provides domain name registration and support services on the Internet.
4. Domain means a character and number designation identifying the address of websites, email and other Internet services.
5. Services means registration, renewal, support, transfer of domain names and related technical support provided to the Subscriber.
6. Registrant means the person for whose benefit a domain name is registered. Registrar means the person ensuring registration and operation of a domain name.
7. DNS, NIC-handle, IP address, Primary DNS, Secondary DNS, MX, A, NS, ICANN and WHOIS are used in the meanings generally accepted in domain name administration and network services.

Subject of the Agreement

1. The Provider supplies the Subscriber with domain name registration and support services in Ukrainian, foreign and international domain zones, as well as technical consulting services related to domain registration.
2. Services are provided through a web interface and specialized hardware and software. Domain registration is performed under the Provider's agreements with domain administrators and other registrar organizations.
3. Domain name operations are carried out according to the rules of the relevant domain zone, including .UA, .COM.UA, .KIEV.UA, .УКР rules, WHOIS regulations, UDRP, UA-DRP and other documents published by domain zone administrators.
4. The Subscriber confirms that domain registration and use do not infringe intellectual property rights or other rights of third parties, and that the contact details provided are accurate and up to date.

Personal Data

1. By entering into this Agreement, the Subscriber confirms acceptance of its terms and consents to personal data processing in accordance with the Law of Ukraine "On Personal Data Protection".
2. Personal data is processed to provide services, issue invoices, prepare acts and other documents, perform settlements, prevent rights violations and ensure technical security.
3. For domain name registration, personal data may be transferred to registry administrators, providers, WHOIS operators, ICANN, escrow agents, auditors and other parties whose involvement is required to provide the services.

Rights and Obligations

1. The Provider must provide services in the scope and under the terms of this Agreement when payment is available, and must take necessary measures to provide quality services and protect the lawful interests of the Registrant.
2. The Subscriber must provide complete, truthful and accurate information, update contact details in time, respond to verification requests, provide identification documents upon the Provider's request and pay for services.
3. The Provider may temporarily or fully suspend services in case of non-payment, inaccurate data, failure to respond to a request, unauthorized access attempts, disruption of services or other breaches of the Agreement.
4. The Subscriber may require provision of services under this Agreement, receive service information and submit complaints, comments and suggestions.

Fees, Payment and Security

1. Payment is made in the national currency according to the tariffs effective at the time of service provision, on a 100% prepayment basis. Services are deemed paid when funds reach the Provider's account.
2. In case of non-payment or late payment, the Provider may suspend or stop providing services and is not liable for consequences of such suspension.
3. The Subscriber is responsible for keeping the login and password secure and for all actions performed through the account. The Subscriber must immediately notify the Provider of unauthorized access or any security breach.

Service Procedure, Liability and Disputes

1. Services are provided "as is". The Provider does not guarantee absence of technical errors, delays, human-factor consequences or force majeure circumstances.
2. The Provider's financial liability is limited to amounts actually received from the Subscriber as payment for the relevant services. The Provider is not responsible for website content published under registered domain names.
3. Service may be terminated without compensation in case of network etiquette violations, illegal content, malicious actions, a court decision or inaccurate contact information.
4. Domain names in the .UA zone may be delegated only to holders of rights to corresponding trademarks. The Registrant must provide supporting documents and accepts the .UA domain rules.
5. The Agreement becomes effective upon payment and remains valid for the term of the ordered service. Claims must be sent to admin@ukrainiandomains.com.ua. If no agreement is reached, the dispute is resolved by a competent court.
6. Transfer of a domain name to another registrar is possible if at least 60 calendar days have passed since registration or the last transfer, the registration term has not expired and no restrictions apply to the domain.
